2. Collection and processing of personal data


We usually do not collect any personal data when you visit the website of the hotel Vier Jahreszeiten am Schluchsee:


Personal data are only collected if you provide us with these data voluntarily, e.g. to request information or within the scope of a query/booking/voucher request. Your personal data will only be transmitted to third parties if this is necessary for contract performance or billing purposes, complying with Section 11 of the Federal Data Protection Act (BDSG) for the contract data processing or if you have granted your consent in advance.


We will not sell your personal data to third parties. We share personal data with third parties only if this is necessary in conjunction with the handling of the contract; for instance, with the financial institution tasked with the processing of payments. 


They will moreover only be forwarded to state institutions and authorities entitled to this information within the scope of imperative legal provisions and/or if we are legally obliged to do so.


If your personal data is being processed in order to engage in direct advertising, you have the right to at any time object to the processing of your affected personal data for the purposes of such advertising. This also applies to profiling to the extent that it is affiliated with such direct advertising. We have obliged our employees to secrecy and to compliance with the data protection provisions.


4. Security


Hetzel-Hotel Hochschwarzwald GmbH&Co.KG employs technical and organisational measures in order to protect your data against accidental or deliberate manipulation, loss, destruction or against access by unauthorised parties. Our security measures are subject to continuous improvement according to technical developments. However, we refer to the fact that security gaps may exist when transferring data on the Internet (with communication by e-mail, for example). Complete protection of the data from access by third parties is not possible.


If possible, confidential information is encrypted by means of SSL certificate and transmitted using the HTTPS protocol. You can recognise an encrypted connection by the address line in the browser changing from http:// to https://.


5. Cookies


Our website uses cookies. Cookies are small text files that are sent from the web server to your PC and in most cases stored on your hard disk. They are not programmes that may cause damage on the user’s PC. Cookies allow us to identify whether you visit our website again. Personal data are not stored. The information cannot be assigned to any specific person.

6. Statistical analysis using MATOMO


This website uses Matomo (previously Piwik), which is an open source software for the statistical analysis of visitor traffic. Matomo uses so-called “cookies”, which are text files stored on your computer to help the website analyse how visitors use the site. This allows us to improve the websites for you and make them more user-friendly. The information produced by the cookie about your use of this website is stored on the service provider’s local server in Germany. The IP address is rendered anonymous straight after processing and before it is stored. The analyses produced using Matomo are completely anonymous and cannot be used to identify individual people. On our website, links to the above-specified services are available. We do not transfer your personal data. On our website, no social plug-ins are used, i.e. if you do not explicitly follow the corresponding links, no data will be transmitted to the specified services.


If you follow these links, your browser will establish a connection with the corresponding social network or service. In this connection, data, e.g. your IP address, are transmitted so that they may be able to assign your visit on our website to an existing user account. You can prevent this assignment by logging off from your corresponding user account.

9. Google AdWords and Google Conversion Tracking

This website uses Google AdWords, an online advertisement service provided by Google Inc. (“Google”). In conjunction with Google AdWords, we use a tool called Conversion Tracking. If you click on an ad posted by Google, a cookie for Conversion Tracking purposes will be placed. The cookies expire after 30 days and are not used to personally identify users. If the user visits certain pages of this website and the cookies has not yet expired, Google and we will be able to recognise that the user has clicked on an ad and has been linked to this page.

The information obtained with the assistance of the Conversion cookie is used to generate Conversion statistics for Ad Words customers who have opted to use Conversion Tracking. The users receive the total numer of users that have clicked on their ads and have been linked to page equipped with a Conversion Tracking tag. However, they do not recieve any information that would allow them to personally identify these users. If you do not want to participate in tracking, you have the option to object to this use by easily deactivating the Goolge Conversion Tracking cookie via your web browser under user settings. If you do this, you will not be included in the Conversion Tracking statistics. 


10. Use of third party services and content


It may happen that third-party content such as YouTube videos, Google Maps map data or RSS Feeds are integrated into our website.


In this connection, the providers of this content need to use the users’ IP address. As without the IP address, they could not send the contents to the browser of the relevant user. We attempt to use only content the provider of which uses the IP address exclusively for the delivery of the content. However, we have no influence if the external providers store the IP address, e.g. for statistical purposes.


11. Newsletter


In the following, we will inform you about the content of our newsletter as well as the registration, sending and statistical analysis procedure and your rights to object. By subscribing to our newsletter, you agree to receive the newsletter and to the described procedure.


We send newsletters, emails and other electronic notifications which include advertising information (in the following referred to as “newsletter”) only with the consent of the recipients or with statutory permission. If the content of a newsletter is precisely described during registration, this content is the basis for the users’ consent. Otherwise, our newsletters contain information about our services and our company.


Double opt-in and logging: Registration for our newsletter is based on a so-called double opt-in procedure. This means that after registration, you will receive an email in which you are asked to confirm your registration. This confirmation is required to ensure that nobody can register using other people’s email addresses. Registrations for the newsletter will be recorded to be able to provide proof of the registration process according to the legal requirements.

The logging of the registration procedure is based on our legitimate interests according to art. 6 (1) GDPR. Our interest lies in using a user-friendly and secure newsletter system serving our business interests and corresponding to the users’ expectations and moreover allowing us to render proof of consents.


Cancelling the subscription/Withdrawing your consent – You can unsubscribe from our newsletter at any time, i.e. withdraw your consent to receiving it. A link to cancel your subscription to the newsletter can be found at the end of each newsletter. An individual application for deletion is possible at any time if at the same time, the former existence of a consent is confirmed.


12. Comment function


For the comment function on the page, we will - in addition to your comment - also store information on the time of the creation of the comment and - if you do not post it anonymously - your selected user name.


13. Contact form


If you send us enquiries using the contact form, we will store your data from the enquiry form including the contact data specified there by you for processing the enquiry and in case follow-up questions arise. We will not collect these data without your consent.


This means that the data entered by you in the contact form will only be processed based on your consent (art. 6 (1) GDPR). You can withdraw this consent at any time. To do so, sending us an informal message by e-mail is sufficient. The lawfulness of the data processing operations based on consent before its withdrawal shall remain unaffected.


The data entered by you in the contact form will remain with us until you ask us to erase them, withdraw your consent to their storage or the purpose for the data storage is omitted (e.g. after completed processing of your enquiry.). Imperative legal provisions – particularly retention periods – shall remain unaffected.


14. Room booking


In order to give you the possibility to book a room using our homepage, an online booking system provided by Busy Rooms GmbH has been integrated into our website. The information provided by you will only be processed for the provision of our contractual services and will naturally be handled confidentially.


15. Right of access, erasure, blocking


According to the Federal Data Protection Act, you are at any time entitled to free access to your stored personal data as well as to the rectification, blocking or erasure of these data, if applicable. 16. Right of Appeal

17. Objection to advertising e-mails


The use of contact data published to comply with imprint obligations for purposes of sending not expressly requested advertisement and information material is hereby rejected. The operators of the website expressly reserve the right to take legal steps in the case of the unsolicited sending
